Bhopal:
A minister in rightist Bharatiya Janata Party ruled Madhya Pradesh,
the central Indian state, has been caught in judicial hot waters for
providing incorrect information in his affidavit during the
legislative assembly elections held in November-December 2008.
BK Singh, the Chief Judicial Magistrate,
(CJM), of Datia town, 320 Kilometers north of Bhopal, has ordered
that Madhya Pradesh parliamentary, law and legislative affairs
minister, Norottam Mishra be arrested and produced before the court
for allegedly giving wrong information in his affidavit.
Reports reaching here said that the CJM
has issued an arrest warrant against Mishra on Thursday under
sections 420 and 193 of Indian Penal Code, (IPC), and section 125 of
People's Representative Act on the charges of giving wrong
affidavit, fraud and enticing voters.
Singh also asked the police to produce
him before the court by March 11 while taking cognizance of a
complaint filed by Bhanupratap Singh Bundela, a resident of Hathlai
village of Datia district.
In his petition, Bundela has alleged that
Mishra not only enticed electorates to ensure his victory from Datia
constituency in November 2008 assembly elections in Madhya Pradesh
but had also committed a fraud by giving wrong information about his
property in the affidavit submitted for the elections.
In his affidavit, the minister had
mentioned that he does not own any four wheeler but during
electioneering a jeep, having registration and other documents in
Mishra's name, was seized by the police under Jigna Police Station
area in the district during a crackdown on those vehicles which were
being used illegally for electioneering.
Later, the minister's nephew, Vivek
Mishra approached the court for the vehicle with an application and
took it back from there.
On the basis of it, Bundela had
complained against the minister in the CJM court through his counsel
Mahipal Singh in September last year.
