The false and derogatory propaganda by the Sanghpariwar
organizations faced a heavy blow when the Karnataka High court
expunged a habeas corpus application filed by the parents of Ashwini
(now Fathima) who converted to Islam and married a Muslim youth, reports sahilonline.org.
According to the report published today in the leading South Indian
portal, the court stated that Ashwini, who is now Noor Fathima, was
over 18 and had converted to Islam on her own individual accord and
right and married Irfan also on her own accord.
There was no
compulsion or force on her to convert to Islam and marry Irfan, it
said.
Talking to the press reporters, after the High Court delivered its
verdict in the case, Noor Fathima, who was completely clad in veil,
reiterated that she had converted to Islam and married Irfan on
her own will and that to describe it as love jihad was lack of
commonsense.
She further said that not having any strong point to present before
the court her parents attempted to prove her mentally weak
before the court, which was rejected by the court itself.
The report says, Irfan on
this occasion, accused the police and some Sanghpariwar
activists for harassment and said that his parents had to face
trouble, which he and Fathima bravely faced with.
The divisional bench consisted of Justice Sridhar Rao and Justice
Subhash Adi, High Court, which delivered its judgment on the habeas
corpus application, filed in the court by Srinivas, a resident of
Gadikoppa in Shimoga district, on December 15, 2009.
According to the report, in its ruling
the court held that the girl was adult and had married and converted
to Islam on her own will, without having any pressure, force or
compulsion from anybody. The court also maintained that currently she was mentally
balanced. Hence, the case couldn't be held as that of kidnap,
missing or forced, it said.
The court delivered its ruling after taking the statement of Noor
Fathima who was accompanied by her husband. On this occasion,
presenting her statement Fathima said that she had embraced Islam on
her own will rather than any force or compulsion.
“A few days ago I had the habit of talking while in sleep. However,
I am mentally balanced. My parents presented the fake health
certificate", sahilonline.org quoted her as saying.
She said that she had not taken any treatment for this and that she
is mentally sound. After the hearing of the case Karnataka High court permitted Fathima to live with Irfan.
The report further said, in their habeas corpus application her
parents had complained that after a phone call in the year 2004, the
mental balance of their daughter was affected and since then she was
not talking to anyone. The doctors had suggested that she must not
be given any mental pressure and must take rest accordingly, their
daughter Ashwini was living in her home from 2005 to 2008. Ashwini
had resumed her education in the year 2009, the habeas corpus said.
It is said that, while studying for her B.Sc. degree in Shimoga's
DVS College, she fell in love with the son of Basheer, a businessmen
of Shimoga. Later, to keep her away from Irfan she was sent to her
grand mother's home. On November 4, 2009 it came to light that she
eloped with Irfan. After a complete search, a complaint was
registered in the police station. Even the period of 40 days, after
her missing, when there was no headway her father Y.S. Srinivas
motivated by the Sanghpariwar activists had appealed to the court to
help him to find her.
It
may be noted that many intellectuals and writers had supported the
cause of conversion and her marriage to Irfan as she had done it on
her own accord. One of them was Ravi Belegere, a well known
Journalist of “Hai Bengaluru” fame. He was also present at the court
when the verdict was and the the Habeas Corpus application expunged
of Srinivas. On this occasion, Ravi Belegere condemned the attempts
of dividing the love on the basis of religion.
Meanwhile, the report says, Irfan in a statement given to
the press said that he had not forced Noor Fathima (Ashwini) in any
way to convert into Islam. "It was sheer love for him that motivated
her to convert into Islam", sahilonline.org quoted Irfan as saying.
