Spanish Judge Fernando Andreu will not backtrack on an investigation opened against Israeli officials over alleged war crime in the Gaza Strip.

The National Court judge said on Monday that he would continue his investigation over a 2002 murder of civilians in the costal sliver despite pressure by the court's prosecutors to shelve the case.

The case involves an air raid on Gaza in which Israeli warplanes dropped a one-ton bomb on the densely populated areas of the enclave, killing Salah Shehadeh, a Hamas activist along with 14 other people.

Last month, public prosecutors advised Andreu to close the case on the grounds that the attack had been under investigation by Israel.

Andreu, however, has announced that the bombing might constitute crime against humanity.

The case might lead to the indictment of former Israeli Defense Minister Benjamin Ben-Eliezer, former Israel Defense Forces Chief of Staff Dan Halutz and five others military and security officials, Haaretz reported.

The Spanish judge wrote that although the Israeli military launched a separate probe into the incident, Israeli prosecutors declined to pursue the case.

Spanish judges can independently launch war crimes investigations against foreign officials. In 1998 a Spanish judge practiced his power, issuing an arrest warrant for former Chilean dictator Augusto Pinochet who was accordingly detained in Britain.
