Pune blast probe: ATS fails to arrest 'prime suspect' Samad

Mumbai: A Sessions court today granted bail to the February 13 German Bakery bomb blast suspect Abdul Samad, arrested for his alleged involvement in the 2009 illegal arms seizure case.

Additional Sessions Judge S L Pathan, while granting bail to Samad, in his order, directed him to furnish a surety of Rs 25,000. The court has asked Samad to give his address and mobile phone details to the investigating officer.

 

He has also been told that he cannot leave the country without the court's permission. His passport has to be deposited with the investigating officer.

Samad, in his bail plea, contended that there were no serious allegations levelled against him and no arms were recovered from him.

''The remaining three accused in the arms case are out on bail. So, on grounds of parity even Samad should be granted bail. Moreover, if his name had figured in this case last year itself, why did the Anti-Terrorism Squad (ATS) wait for a year before arresting him? He has been falsely implicated,'' Samad's lawyer Mubin Solkar argued before the court.

 

The application was strongly opposed by the prosecution, which contended that if Samad is released on bail, he may influence the witnesses and tamper with evidence.

Samad, who is lodged at Arthur Road jail, had earlier moved the Sessions court after the Metropolitan Magistrate rejected his bail plea, stating that investigation was still underway.

He was arrested by ATS on May 25 from the Mangalore airport and was booked under the Arms Act for supplying firearms to three other persons, who were arrested in August last year.

Soon after his arrest, Union Home Minister P Chidambaram had stated that Samad was a prime suspect in the German Bakery blast in Pune that claimed 17 lives.

However, ATS has till now not booked Samad in the Pune blast case.
