New Delhi: A lawyer on whose petition Madras High Court has directed Census Commissioner of India to conduct a caste based census today filed a caveat in the Supreme Court praying that no relief should be granted to the Union Government without hearing caveator.

A bench comprising acting Chief Justice of the Madras High Court Elipe Dharma Rao and Justice T Sivagnanam on May 13 had directed the Union Government, Census Commissioner to take census on caste basis.

While upholding the Central government notification providing 27.5% quota to OBC (other backward classes) in centrally run educational institutions of higher studies, the Supreme Court had told the Union Government to come out with better data of the percentage of OBC in the population of the country.

Last caste based census was conducted 79 years ago in 1931 which cannot be the basis of providing the reservation to OBC in various government schemes including education and jobs, the apex court had said.

The petitioner in his affidavit has sought directions to the Union Government to implement the recommendations of Kaka Kalekar and Mandal Commission reports.

According to the petitioner, census provides basis for the government to prepare policies for the welfare of socially, educationally and economically backward sections of society.

Union government has already indicated that it is not averse to caste based census.
