New Delhi: Prodding the Delhi Government to order a judicial inquiry into the Batla House encounter in the Capital last year, the Delhi High Court yesterday said its obduracy to oppose a the demand would only deepen suspicion about the bona fides of the Delhi Police in the case. A Division Bench of the Court comprising Justice A.P.Shah, and Justice N.K. Kaul said the judicial enquiry if conducted would only be a fact finding exercise and its report would not be used in any other proceedings connected to with the encounter.


The Bench said that the inquiry report would be submitted to the National Human Rights Commission which would decide the future course of action after perusing it. “When other States conducted a judicial enquiry into every encounter and submitted the probe report to the National Human Rights Commission, then why the Delhi Government was objecting to it, trying to treat the encounter as different”, thundered the Bench. Directing the Counsel for the Government to take instructions from his client in the matter the Delhi High Court adjourned the hearing to May 04.


The Division Bench has been hearing a petition by a Non Governmental Organization seeking a probe into the much talked about encounter. The Delhi Police from the very beginning have been opposing the demand for the judicial inquiry into the encounter. Justifying their opposition to the demand, the police had earlier this month submitted before the Delhi High Court that a judicial enquiry might cause demoralization among its officials. The petitioner Act Now for Harmony and Democracy sought a judicial inquiry into the “encounter” arguing that the facts and circumstances of the incident on September 19, 2008 in which two suspected terrorists and a Delhi Police Officer were killed created doubts in the public mind about its veracity.


On the other hand the National Human Rights Commission has submitted before the Delhi High Court that it is wholly unacceptable on part of the Delhi Police to refuse the demand for a Magisterial enquiry into the Batla House encounter and circumstances that led to the death a senior official of the Delhi Police. The Counsel of the National Human Rights Commission contended if the Delhi Police maintains rigidity in its stand then, it will set a precedence for anybody to escape enquiry.


In the meanwhile, the former Council of Okhla Asif Mohammad Khan who is spearheading a campaign against the Delhi Police, Delhi Government and the Congress since the encounter on September l9 last year had distributed handbills in the area. According Asif Mohammad Khan, “The purpose of these handbills is to create awareness in the public on the question ‘On what basis shall we vote’”? Mr. Asif Mohammad Khan appealed to the Muslims that when the Sikhs had hurled a shoe at the Home Minister P. Chidambaram and also forced the two candidates out of the fray then why the Muslims are so weak for their rights.


Mr. Asif Mohammad Khan further told that he was going to start a series of question with Delhi Chief Minister Ms. Sheila Dikshit and ask her what your government had done for the Muslims during the ten year rule? Asif Mohammad Khan wields a tremendous public support. This can be gauged from the fact that in the last Assembly Elections he gave very very tough fight to the Congress candidate, however, lost by a very very narrow margin of just over five hundred votes. This popularity of Asim Mohammad Khan is bound to give some jittery to Congress this time around also.


Earlier Congress victory was taken for granted, however, Asif Mohammad Khan’s public work has turned the tide in his favour. Actually Asif Mohammad Khan has published a political advertisement in the Urdu newspapers in which he without naming Congress has put big question mark on the performance of Congress. Asif Mohammad Khan has asked, “Why should we vote”? After this lead question he has raised some other questions. This has created ripples in the Muslim voters of Okhla. The general voters of Okhla are now forced to give a second thought that why should we vote for the Congress.


According to the latest reports the relatives of the two Muslims youths who were killed by the Delhi Police” and the two Muslim youths arrested in the Batla House “encounter” are sitting on a Dharna at the Batla House Square. They are holding the placards and banners on which “Humein Insaaf Chahiye” (We Want Justice) is inscribed. Some other placards read “Humaray Ma’soom Bacchon Ko Riha Karo” (Release Our Innocent Children), “Delhi Police Qaatil Hai” (Delhi Police Is Murderer), “Batla House Encounter Ki Adalti Janch Karao” (Order Judicial Inquiry Into Batla House Encounter).  This step has been taken by the aggrieved families in view of a road show after Juma Prayers at Batla House Square by the son of Chief Minister Sheila Dikhsit and Congress candidate from North Delhi Parliamentary Constituency Sandeep Dikshit.
