Malegaon: It was on September 08, 2006, on the eve of Shab-e-Barat, when people had just finished their Friday prayers, series of bombs planted on brand new bicycles exploded in Malegaon Qabristan killing more than thirty people and injuring scores of people.

 

The investigations were on with allegations and counter allegations about the way investigations were carried out. Ultimately, on 30th October at 04:20 PM the ATS- Anti Terrorism Squad (ATS) produced Noorul Huda Shamsuddoha in Malegaon court as an accused and planter of one of the serial bomb blast. At the same time Director General of Maharashtra Police, Dr. Pasricha declared this arrest in a press conference in Mumbai  and claimed that they had ultimately cracked down the conspiracy of Malegaon bomb blasts and Noorul Huda was the first arrest in this regard. Dr. Pasricha was accompanied by ASP Mr. Rajwardhan in the press conference.

 

Two days after the arrest of Noorul Huda, ATS arrested Shabbir Ahmed Masihullah on November 02, 2006 as a mastermind of the Malegaon bomb blast. Before that they already had Raees Ahmed Rajjab Ali as a co-accused in the bomb blast and the petition seeking the permission for Raees’s brain mapping was already with Hon’ble court.

 

People of Malegaon were yet to believe these arrests when police arrested two prominent doctors in the same case, one from Malegaon and the other from Mumbai under MCOCA late in the evening on November 06, 2006 and produced them in a Mumbai court on November 07, 2006. The two arrested medical practitioners were Dr. Salman Farsi Ab. Lateef Aimi and Dr. Farogh Makhdomi Iqbal Ah.

 

While Dr. Salman Farsi was arrested from his Govandi residence in Mumbai, Dr. Farogh was picked up from his Malegaon dispensary-cum-residence. With these arrests, the number of arrested in Malegaon bomb blast went to five.

 

People of Malegaon were shocked when they learnt of these arrests. They were still not able to believe ATS theory that Malegaon bomb blast was the handiwork of Muslims and those who had been arrested were anything to do with the blasts.

 

But the question now is, is it a mere emotion and their passion that people of Malegaon are unable to believe the ATS theory or they have any concrete proof of their innocence?

 

A close look at the whole events justifies their claim to some extent. Advocate S. S. Shaikh, vice-president of Jamiatul Ulema Malegaon, claimed that the whole investigation were carried out in the wrong directions and despite providing the clues to the investigating agencies the scope of investigations had not been widened. Advocate Shaikh claimed that Dashrath Pawar, whose sketches were released immediately after the bomb blast and who was said to be the main culprit of the bomb blasts, was not under detention while innocent Muslims were picked up and arrested by ATS. He said several reports suggested that people living in nearby villages were aware of the bomb blasts and sited one of those reports wherein one non-Muslim gave some indications of the bomb blast in front of a Muslim patient in a missionary hospital in nearby Manmad.

 

Advocate Sudhir B. Akkar of Malegaon Bar Association has also expressed his displeasure about the way investigations are being carried out and says it seems investigating agencies are safeguarding the real culprits and conspirators of the bomb blast.

 

Maulana Ab. Hameed Azhari reacting on these arrests said, from the day one, we demanded that the investigation be handed over to CBI since we did not trust police and ATS and now after the arrests of innocent people our demand for CBI enquiry is vindicated. When asked how he could prove their innocence he remarked, for Noorul Huda, the whole population of Malegaon is ready to claim his innocence.

 

Maulana Azhari, Advocate Shaikh and Advocate Akkar are not the only voice to claim the innocence of those detained by ATS. People wonder, Noorul Huda, who was initially arrested for unlawful activities, later arrested for planting the bomb at Mohammadia Mosque two days after the serial blasts, which the high level police officials themselves claimed as fake. People said, police officials were so sure of their claim that they organized several corner meetings of the dignitaries on the same evening, to convey that the bomb which was found at Mohammadia mosque was actually fake and was a mixture of mud with some kind of fire-cracker powder.

 

People wondered, the bomb which was claimed by the top police officials as fake, had not only become “REAL” but the planter of the said bomb was also arrested and now ATS claimed that the same Noorul Huda was the planter of one of the bombs at Qabristan that exploded on September 08, 2006 in Malegaon. That too when Noorul Huda was under constant police vigil since 2001 when he was first arrested by police and ultimately acquitted by the honorable court.

 

The other accused, Shabbir Ahmed Masihullah, who the ATS claimed as one of the conspirators of Malegaon bomb blasts, was already under police custody in Mumbai when bomb blasts occurred in Malegaon. He was in police custody since August 2006 when he was arrested in an arms haul case and his Norco analysis tests were also reportedly carried out before the blasts.

 

Two persons, one under constant police vigil and the other already under police custody, people were still wondering about how these people fooled the police and successfully carried out the bomb blasts in Malegaon, ATS arrested yet another persons who were also on police records, creating more suspicion in people’s mind about the investigations.

 

Although, the ATS has claimed that they have not arrested any innocent person and they have concrete proof against the accused, people are unable to digest their claim.

 

While all these arrests are being made, the persons in the sketches, released immediately after the bomb blasts, appear to be more relaxed now.
